Cash for Clunkers Results Finally In: Taxpayers Paid $24,000 per Vehicle Sold, Reports Edmunds.com

SANTA MONICA, Calif. — October 28, 2009 — Edmunds.com, the premier resource for online automotive information, has determined that Cash for Clunkers cost taxpayers $24,000 per vehicle sold.

Nearly 690,000 vehicles were sold during the Cash for Clunkers program, officially known as CARS, but Edmunds.com analysts calculated that only 125,000 of the sales were incremental. The rest of the sales would have happened anyway, regardless of the existence of the program.

Ironically, the average transaction price for a new vehicle in August 2009 was only $26,915 minus an average cash rebate of $1,667.

“This analysis is valuable for two reasons,” explained Edmunds.com CEO Jeremy Anwyl. “First, it can form the basis for a complete assessment of the program’s impact and costs. Second—and more important—it can help us to understand the true state of auto sales and the economy. For example, October sales are up, but without Cash for Clunkers, sales would have been even better. This suggests that the industry’s recovery is gaining momentum.”

The chart below sets forth actual SAAR (Seasonally Adjusted Annual Rate) compared to Edmunds.com’s forecasted rate if the program had never been implemented.

“Our research indicates that without the Cash for Clunkers program, many customers would not have traded in an old vehicle when making a new purchase,” Edmunds.com Senior Analyst David Tompkins, PhD told AutoObserver.com. “That may give some credence to the environmental claims, but unfortunately the economic claims have been rendered quite weak.”

To conduct the analysis, the Edmunds.com team of PhDs and statisticians examined the sales trend for luxury vehicles and others not included in Cash for Clunkers, and applied the historic relationship of those vehicles to total SAAR to make informed estimates. These estimates were independently verified through careful examination of sales patterns reflected by transaction data. Once the numbers were determined, Edmunds.com’s analysts divided three billion dollars by 125,000 vehicles to arrive at the average $24,000 per vehicle.

Coincidentally, a parallel analysis of the first-time homebuyer credit was reported yesterday by MIT Sloan Professor Simon Johnson and Yale law student James Kwak, who both blog about economics at The BaseLine Scenario.

Democratic Party Immersed In Culture Of Corruption.

You may not know it if you read only the mainstream media, but even The Associated Press put out a story headlined “Analysis: Democrats self-destructing over ethics.”

I’d change that headline to read “Democrats self-destructing over ethics and criminality.” The Democratic Party of retreat and defeat, anti-military and anti-family values, is rapidly becoming the party of tax cheats, of the corrupt and of the ethically challenge. When the head of the IRS is an admitted tax cheat, you’ve got to admit the party is self-destructing.

Who has done all the talking about the culture of corruption? Rep. Nancy “San Francisco Values” Pelosi (D-Calif.) and former chairman of the Democratic National Committee, Howard Dean, who hold themselves and their party out as the great models of morality and as having high ethical standards. We are indebted to them for creating that terminology, which now so aptly applies to the corrupt culture of their own Democratic Party. And who promised the most ethical Congress in history? The same Rep. Pelosi.

Yes, the Democratic Party’s culture of corruption continues in full force, with the latest addition coming from the new senator from Illinois, Roland Burris. He is now under a criminal investigation in Springfield for perjury and is subject to a U.S. Senate investigation in Washington, D.C. This is perhaps the most important Democrat to commit perjury since President Bill Clinton’s perjury and impeachment (leading to acquittal by the Senate). Both Democrat and Republicans are demanding Sen. Burris’s resignation, including Gov. Pat Quinn, the new Democratic governor of Illinois. Even the White House got into the act, by asking him to take time out and think his position over.

The new senator was supposed to be that rare, clean Chicago politician. That’s what he told the legislature and they believed him. Perhaps when vetting Chicago politicians by Chicago politicians, the word “clean” has to be thought of as relative.

Sen. Burris is a former attorney general of Illinois, so when he testified before the Illinois legislature, he surely knew what he was doing when he failed to answer questions fully and truthfully about his contacts with Rod Blagojevich and members of his staff.

This adds further emphasis to one of the great corruption scandals of recent years involving the ex-governor of Illinois, Mr. Blagojevich, who was recently impeached for trying to sell the senate seat vacated by President Barack Obama. This also puts the spotlight on the Obama-Blagojevich connection, as Mr. Obama supported Mr. Blagojevich in both of his gubernatorial runs, even after knowing, in the most recent, run that the then-governor was under investigation. But then-Sen. Obama has a record of not only associating with crooks and those under investigation, but also entering into business deals with them.

Of course, I’m referring to the now-convicted felon, Tony Rezko, who entered into a questionable land deal with Mr. Obama. The fully story on that smelly transaction is still to be revealed, as is so much of the Obama record. Another crony of Mr. Blagojevich, the impeached governor, is none other than Mr. Rezko. So we might use the old New Jersey slogan and say Messers. Obama, Rezko and Blagojevich … perfect together. And until the details of the criminal investigation of Mr. Blagojevich are made pubic, we won’t know of the role of Mr.Obama’s Chief of Staff Rahm Emanuel or others in the Obama fold.

The Burris-Blagojevich scandal also should spotlight the corrupt Chicago political machine, which seems unable to produce an honest politician. So remember that your president came out of the sewage and slime that has always been the main ingredient of the Chicago political culture, considered the most corrupt political machine in the U.S.

Also remember that Mr. Obama supported this corrupt political machine throughout his career and refused to support a move to try to reform the political machine. With that history and connection to the corrupt Chicago political machine, don’t set your ethical and political expectations too high.

And don’t assume Sen. Burris is the only recent addition to the parade of corrupt Democratic politicians in the news. Another new addition is Rev. Al Sharpton, a key figure in Democratic politics. You’ll recall that when Caroline Kennedy made her disastrous, brief run for an appointment to the U.S. Senate, she paid homage to Rev. Sharpton, as all New York politicians and Democratic presidential candidates routinely do. That says something about the state of New York politics and the culture of corruption of the Democratic Party.

Rev. Sharpton is in the news now, as he is protesting a New York Post cartoon that showed two policemen shooting a berserk chimp, with the caption reading, “They’ll have to find someone else to write the next stimulus bill.”

Rev. Sharpton seems to think the chimp is meant to be President Obama. The cartoonist and the Post editors knew that Rep. Pelosi and her liberal elite in the House drafted the stimulus package, not President Obama. They also knew that a chimp or monkey is often used to represent someone that is not too bright.

I would think a cartoonist, under those facts, would be entitled to the benefit of the doubt. But the Rev. Sharpton protest has one useful purpose: It spotlights that the old race baiter, race hustler and shakedown artist is at work again.

This Democratic stalwart is also in the news, as he is on a speaking tour in Syracuse, N.Y. with the subject of personal responsibility and a call to service. Well, it turns out that Rev. Sharpton ought to exercise a little personal responsibility himself by paying his taxes. He’s been in the news for years for owing millions in taxes to New York City and State.

The only surprising aspect of that report is that as for some reason this prominent Democrat and tax cheat wasn’t nominated for a position in the Obama cabinet, so he could keep company with the other tax cheats, both nominated and confirmed. Of course, Rev. Sharpton should have been knocked out of public life by his involvement in the Tawana Brawley scandal, which ended with Rev. Sharpton being on the losing end of a defamation lawsuit brought by a prosecutor.

That prosecutor had been falsely accused of kidnapping and raping Ms. Brawley, the teenager whose allegations of rape turned out to be a hoax. Only in the Democratic Party could such a politician survive and prosper after being involved in the Brawley outrage. But remember Rep. Alcee Hastings, D-Fla., who was elected to Congress after he was impeached while serving as a federal judge. He was defeated in the last election.

The Blagojevich scandal was probably even a more shocking scandal than that involving the resigned governor of New York, Elliot Spitzer, another outstanding Democrat who, like Mr. Blagojevich, had presidential aspirations. He was involved with call girls after posing as the great moralizer as attorney general and governor. But Mr. Spitzer’s resignation in New York was only the beginning of the cult ure of corruption there.

His successor, Gov. David Paterson had a chief of staff, Charles J. O’Byrne who had to resign over tax problems. He suffered from the non-filer syndrome. He didn’t pay his taxes. But Gov. Patterson’s office is in such disarray that he said he was going to bring Mr. O’Byrne back. So apparently, the tax cheaters are so talented and effective that they are essential in Democratic administrations, even if they are tax cheats. As one wise man observed, being a tax cheat is almost a prerequisite for the Obama cabinet. Maybe it is for Mr. Patterson’s circle, too.

You’ll recall the noted tax cheat, Tim Geithner, who was the only man who could do the job as Secretary of the Treasury. But the Democratic Senate had no problem in confirming a tax cheat, who has conclusively proved now on the job he is not as brilliant as he was claimed.

Incidentally, Mr. O’Byrne decided not to come back to his old job. And former U.S. Sen. Tom Daschle, D-S.D., was also billed as so talented he was the only man who could manage the passage of universal health insurance. He stepped down, too, over his tax and conflict of interest problems.

Why do so many brilliant Democrats have an aversion to paying their taxes? They have no aversion to raising taxes.

There’s one thing worse than having a tax cheat as head of the IRS. And that’s having a Democratically-controlled Senate that confirms his nomination. This Democratic Senate is obviously in the business of giving consent but not advice when passing on presidential nominations.

Another in the long list of Democratic would-be office holders with tax problems is Nancy Killefer, who was to head a newly created office to eliminate inefficient government programs. She stepped down when her tax problems were discovered. Too bad, as with her record, she would probably have tried to eliminate the IRS.

Depending on the outcome of the U.S. Senate election in Minnesota, the Democrats may get another office holder who doesn’t seem to be able to pay taxes. Even before Al Franken ran in Minnesota, it was discovered he failed to pay $70,000 in taxes owed in 17 states.

Of course, the Democratic leadership in Congress may think that citizens should be able to cheat on their taxes. I’m referring to Rep. Charles Rangel, D-N.Y., chairman of the House Ways and Means Committee, the tax writing committee of Congress.

He’s the subject of an ethics investigation, focusing on his failure to pay taxes, his financial disclosures, and his fund raising practices for a college center named for him.

We can count on Rep. John Murtha, D-Pa., to come into this picture of ethical self-destruction by the Democrats, as he has long been under an ethical cloud going back to ABSCAM. The latest bit now in the news, as reported by the AP, involves Federal agents raiding a lobbying firm with strong Murtha connections, apparently on the suspicion of illegal campaign contributions to a number of Congressmen. Rep. Murtha has been responsible for $1 million in federal funds going to the lobbying firm’s clients. And the lobbying firm, headed by a former top Murtha aide, has been responsible for giving him $143,600 in contributions.

Rep. Murtha, when not busy with his ethical problems, spends his time slandering American military personnel. Remember his comment about how certain members of the military had murdered people in cold blood. And when proven wrong, you know he’s not going to apologize. We’ll have to wait to see if anything comes of this latest investigation. Remember that Mr. Murtha has a knack of escaping from these ethical challenges.

While on the culture of corruption, we can’t forget New Mexico Gov. Bill Richardson, who was nominated to be Secretary of Commerce but had to withdraw as he is under investigation in his home state.

I’d say that the Attorney General’s part in pardoning terrorists and Marc Rich, the fugitive from justice, also raises ethical and corruption issues.

There are also organizations associated with the Democratic Party that also raise culture of corruption issues. Perhaps the best example is ACORN, the community organization, long associated with committing voter fraud and intimidation tactics against banks.

To round out the picture, there’s the former Mayor of Detroit, Kwame Kilpatrick, who stepped down when facing perjury charges. He was finally convicted of obstruction of justice. Then he served jail time and is now out on five-year probation.

And who can forget former Louisiana Rep. William “Cash in the Fridge” Jefferson, who has since been defeated for Congress. He was accused of bribery, and when the FBI raided his home, they found a freezer stuffed with cash. Well, you have to keep cash cold, as it gets hot in Louisiana.

Finally, there is Massachusetts State Sen. Dianne Wilkerson who was nailed by the FBI for bribery.

As I was finishing this column, reports came out that a mutual fund controlled by the Vice President Joe Biden’s family has connections with Alan Sanford, the Texas financier responsible for the $8 billion mini-Madoff financial scandal. But it is too early to tell if the Biden family members, his son, Hunter, and his brother, James, have been involved in any ethical missteps in this matter.

Now that sounds like a damning lineup of the corrupt and the ethically challenged and questioned. But it is still a small part of the Democratic Party’s problems. Its main problem is that it has become a far-left, radical, leftist, socialist party that is weak on defense and national security and strong on higher taxes, more regulation and bigger government.

And it has become a party that has abandoned democratic values by lending its support to the card check bill to outlaw secret ballots in union elections and to the Fairness Doctrine, which, in effect, calls for the regulation and suppression of free speech. Where has the Democratic Party gone? It has abandoned its core principles, every one. And what will be the fate of America with the Democratic Party in control of the White House and Congress?

A move to expel Frank from the House of Representatives failed and a motion to censure him failed.

DNC - The Federal Election Commission imposed $719,000 in fines against participants in the 1996 Democratic Party fundraising scandals involving contributions from China, Korea and other foreign sources. The Federal Election Commission said it decided to drop cases against contributors of more than $3 million in illegal DNC contributions because the respondents left the country or the corporations are defunct.

Sandy Berger - Democrat - National Security Advisor during the Clinton Administration. Berger fined $50,000 for illegally removing highly classified documents and handwritten notes from the National Archives during preparations for the Sept. 11 commission hearings.

Robert Torricelli - Democrat - Withdrew from the 2002 Senate race with less than 30 days before the election because of controversy over personal gifts he took from a major campaign donor and questions about campaign donations from 1996.

James McGreevey - Democrat - New Jersey Governor . Admitted to having a gay affair. Resigned after allegations of sexual harassment, rumors of being blackmailed on top of fundraising investigations and indictments.

Jesse Jackson - Democrat - Democratic candidate for President. Admitted to having an extramarital affair and fathering a illegitimate child.

Sowande Ajumoke Omokunde - Democrat - the son of newly elected U.S. Rep. Gwen Moore, was booked on charges of criminal damage to property for allegedly slashing tires on 20 vans and cars rented by the Republican Party for use in Election Day voter turnout efforts.

Daniel David Rostenkowski - Democrat - U.S. Representative from Illinois from 1959 to 1995. Indicted on 17 felony charges- pleaded guilty to two counts of misuse of public funds and sentenced to seventeen months in federal prison.

Melvin Jay Reynolds - Democrat U.S. Representative from Illinois from 1993 to 1995. Convicted on sexual misconduct and obstruction of justice charges and sentenced to five years in prison.

Wayne Bryant - Democrat NJ state senator- was convicted was found guilty on all 12 counts against him including bribery and pension fraud.

Charles Coles Diggs, Jr. - Democrat - U.S. Representative from Michigan from 1955 to 1980. Convicted on eleven counts of mail fraud and filing false payroll forms- sentenced to three years in prison.

George Rogers - Democrat - Massachusetts State House of Representatives from 1965 to 1970. M000ember of Massachusetts State Senate from 1975 to 1978. Convicted of bribery in 1978 and sentenced to two years in prison.

Don Siegelman - Democrat Governor Alabama - indicted in a bid-rigging scheme involving a maternity-care program. The charges accused Siegelman and his former chief of staff of helping Tuscaloosa physician Phillip Bobo rig bids. Siegelman was accused of moving $550,000 from the state education budget to the State Fire College in Tuscaloosa so Bobo could use the money to pay off a competitor for a state contract for maternity care.

John Murtha, Jr. - Democrat - U.S. Representative from Pennsylvania. Implicated in the Abscam sting, in which FBI agents impersonating Arab businessmen offered bribes to political figures; Murtha was cited as an unindicted co-conspirator.

Otto Kerner - Democrat governor of Illinois from 1961 to 1968 was jailed after the manager of two horse-racing tracks admitted to bribing the then- governor; charges were filed after Kerner left office he was convicted in 1973.

Dan Walker - Democrat governor of Illinois from1973 to 1977 served less than two years of a seven-year sentence for receiving improper loans a decade after leaving office.

Gerry Eastman Studds - Democrat - U.S. Representative from Massachusetts from 1973 to 1997. The first openly gay member of Congress. Censured by the House of Representatives for having sexual relations with a teenage House page.

Hiram Monserrate- Queens City Councilman and state Senator-elect - who has claimed to be an advocate of victims of domestic violence - was arrested for breaking a glass over his girlfriend’s face. Monserrate, 41, a former cop, won election to the state Senate as a Democrat in November 2008.

James C. Green - Democrat - North Carolina State House of Representatives from 1961 to 1977. Charged with accepting a bribe from an undercover FBI agent, but was acquitted. Convicted of tax evasion in 1997.

Frederick Richmond - Democrat - U.S. Representative from New York from 1975 to 1982. Arrested in Washington, D.C., in 1978 for soliciting sex from a minor and from an undercover police officer - pleaded guilty to a misdemeanor. Raymond Lederer - Democrat - U.S. Representative from Pennsylvania from 1977 to 1981. Implicated in the Abscam sting - convicted of bribery and sentenced to three years in prison and fined $20,000.

Harrison Arlington Williams, Jr. - Democrat - U.S. Senator from New Jersey from 1959 to 1970. Implicated in the Abscam sting. Allegedly accepted an 18% interest in a titanium mine. Mario Biaggi - Democrat - U.S. Representative from New York from 1969 to 1988. Indicted on federal charges that he had accepted bribes in return for influence on federal contracts.Convicted of obstructing justice and accepting illegal gratuities. James A. Traficant Jr. - Member of House of Representatives from Ohio. Expelled from Congress after being convicted of corruption charges. Sentenced today to eight years in prison for accepting bribes and kickbacks.

John Doug Hays - Democrat - member of Kentucky State Senate from 1980 to 1982 Found guilty of mail fraud for submitting false campaign reports stemming from an unsuccessful run for judge. He was sentenced to six months in prison to be followed by six months of home confinement and three years of probation.

David Hall - Democrat - Governor of Oklahoma from 1971 to 1975. Indicted on extortion and conspiracy charges. Convicted and sentenced to three years in prison.

John A. Celona - Democrat - A former state senator was charged with the three counts of mail fraud. Federal prosecutors accused him of defrauding the state and collecting hundreds of thousands of dollars from CVS Corp. and others while serving in the legislature. Celona has agreed to plead guilty to taking money from the CVS pharmacy chain and other companies that had interest in legislation. Under the deal, Celona agreed to cooperate with investigators. He faces up to five years in federal prison on each of the three counts and a $250,000 fine

The Logan Act makes it a felony and provides for a prison sentence of up to three years for any American, “without authority of the United States,” to communicate with a foreign government in an effort to influence that government’s behavior on any “disputes or controversies with the United States.”

OBAMA TRIED TO STALL GIS’ IRAQ WITHDRAWAL

WHILE campaigning in public for a speedy withdrawal of US troops from Iraq, Sen. Barack Obama has tried in private to persuade Iraqi leaders to delay an agreement on a draw-down of the American military presence.

According to Iraqi Foreign Minister Hoshyar Zebari, Obama made his demand for delay a key theme of his discussions with Iraqi leaders in Baghdad in July.

“He asked why we were not prepared to delay an agreement until after the US elections and the formation of a new administration in Washington,” Zebari said in an interview.

Obama insisted that Congress should be involved in negotiations on the status of US troops - and that it was in the interests of both sides not to have an agreement negotiated by the Bush administration in its “state of weakness and political confusion.”

“However, as an Iraqi, I prefer to have a security agreement that regulates the activities of foreign troops, rather than keeping the matter open.” Zebari says.

Though Obama claims the US presence is “illegal,” he suddenly remembered that Americans troops were in Iraq within the legal framework of a UN mandate. His advice was that, rather than reach an accord with the “weakened Bush administration,” Iraq should seek an extension of the UN mandate.

While in Iraq, Obama also tried to persuade the US commanders, including Gen. David Petraeus, to suggest a “realistic withdrawal date.” They declined.

Obama has made many contradictory statements with regard to Iraq. His latest position is that US combat troops should be out by 2010. Yet his effort to delay an agreement would make that withdrawal deadline impossible to meet.

Supposing he wins, Obama’s administration wouldn’t be fully operational before February - and naming a new ambassador to Baghdad and forming a new negotiation team might take longer still.

By then, Iraq will be in the throes of its own campaign season. Judging by the past two elections, forming a new coalition government may then take three months. So the Iraqi negotiating team might not be in place until next June.

Then, judging by how long the current talks have taken, restarting the process from scratch would leave the two sides needing at least six months to come up with a draft accord. That puts us at May 2010 for when the draft might be submitted to the Iraqi parliament - which might well need another six months to pass it into law.

Did President Obama Committed Open Treason?

When the president of the United States, Barack H. Obama accepted rotating status as chairman of the United Nations Security Council, he committed high treason… not only a direct violation of article 1 section 9 clause 7 of the Constitution for the United States of America, which states emphatically:

“No title of nobility shall be granted by the United States; and no person holding any office of profit or trust under them, shall without consent of Congress accept of any present, emolument, office, or title, of any kind whatever, from any King, Prince, or foreign State.”

But this act by the President also has violated the 13th article of amendment that was duly ratified by March of 1819, but with secrecy and by active subterfuge, it was replaced by Lincoln’s 14th amendment right after the Civil War. This duly ratified original 13th amendment states the following:

“If any citizen of the United States shall accept, claim, receive, or retain any title of nobility or honour, or shall without the consent of Congress, accept and retain any present, pension, office, or emolument of any kind whatever, from any emperor, king, prince, or foreign power, such person shall cease to be a citizen of the United States, and shall be incapable of holding any office of trust or profit under them, or either of them.”

Article 1 section 9 describes what shall not be allowed, but, it puts forth no punishment for such actions on the part of an elected government official… the original 13th amendment however, which was proposed in 1810… and some would say was a large part of the reason for the War of 1812, not only states that an elected government official cannot accept this kind of gratuity or office, but also states, if so done, the official would lose all possibility of office present and future, as well as citizenship, and if the circumstances are grave enough could be tried for treason and ultimately hung.

In either case I do not recall there having been a bill, resolution, or memorial, put forth by Congress, granting this president its permission for accepting the position of chairman of the Security Council of the United Nations… Without this permission and open discussion about it, prior to the granting of the permission… President Barack H. Obama is in violation of article 1 section 9 clause 7 of the Constitution for the United States of America… at the very least.

The three classes H.R. 11654 provides for are the organized militia, henceforth known as the National Guard of the State, Territory and District of Columbia, the unorganized militia and the regular army. The militia encompasses every able-bodied male between the ages of 18 and 45. All members of the unorganized militia have the absolute personal right and 2nd Amendment right to keep and bear arms of any type, and as many as they can afford to buy.

The Dick Act of 1902 cannot be repealed; to do so would violate bills of attainder and ex post facto laws which would be yet another gross violation of the U.S. Constitution and the Bill of Rights. The President of the United States has zero authority without violating the Constitution to call the National Guard to serve outside of their State borders.

The National Guard Militia can only be required by the National Government for limited purposes specified in the Constitution (to uphold the laws of the Union; to suppress insurrection and repel invasion). These are the only purposes for which the General Government can call upon the National Guard.

Attorney General Wickersham advised President Taft, “the Organized Militia (the National Guard) can not be employed for offensive warfare outside the limits of the United States.”

The Honorable William Gordon, in a speech to the House on Thursday, October 4, 1917, proved that the action of President Wilson in ordering the Organized Militia (the National Guard) to fight a war in Europe was so blatantly unconstitutional that he felt Wilson ought to have been impeached.

During the war with England an attempt was made by Congress to pass a bill authorizing the president to draft 100,000 men between the ages of 18 and 45 to invade enemy territory, Canada. The bill was defeated in the House by Daniel Webster on the precise point that Congress had no such power over the militia as to authorize it to empower the President to draft them into the regular army and send them out of the country.

The fact is that the President has no constitutional right, under any circumstances, to draft men from the militia to fight outside the borders of the USA, and not even beyond the borders of their respective states. Today, we have a constitutional LAW which still stands in waiting for the legislators to obey the Constitution which they swore an oath to uphold.

Charles Hughes of the American Bar Association (ABA) made a speech which is contained in the Appendix to Congressional Record, House, September 10, 1917, pages 6836-6840 which states: “The militia, within the meaning of these provisions of the Constitution is distinct from the Army of the United States.” In these pages we also find a statement made by Daniel Webster, “that the great principle of the Constitution on that subject is that the militia is the militia of the States and of the General Government; and thus being the militia of the States, there is no part of the Constitution worded with greater care and with more scrupulous jealousy than that which grants and limits the power of Congress over it.”

“This limitation upon the power to raise and support armies clearly establishes the intent and purpose of the framers of the Constitution to limit the power to raise and maintain a standing army to voluntary enlistment, because if the unlimited power to draft and conscript was intended to be conferred, it would have been a useless and puerile thing to limit the use of money for that purpose. Conscripted armies can be paid, but they are not required to be, and if it had been intended to confer the extraordinary power to draft the bodies of citizens and send them out of the country in direct conflict with the limitation upon the use of the militia imposed by the same section and article, certainly some restriction or limitation would have been imposed to restrain the unlimited use of such power.”

Congressman Broun warns of “socialistic elite” and their plans for a dictatorship.

Remember back in July 2008 on the campaign trail, Obama called for a “civilian national security force that’s just as powerful, just as strong, just as well funded,” as the U.S. military?

Georgia Congressman Paul Broun warned attendees of a town hall event Tuesday that the Obama administration was planning to use a pandemic or a natural disaster to implement martial law in the United States.

Speaking at the North Georgia Technical College auditorium, Broun said that the “socialistic elite,” as well as Obama, Nancy Pelosi and Senate Majority Leader Harry Reid, were planning to exploit a crisis to create a favorable climate for their stalling political agenda.

“They’re trying to develop an environment where they can take over,” he said. “We’ve seen that historically.”

Broun’s warning arrives on the back of a letter sent by The National Governors Association to the Pentagon last week, which condemns the military’s plans to usurp domestic control of National Guard and federal forces deployed in the event of a natural disaster or terrorist attack.

In December 2008 it was announced that at least 20,000 more active duty soldiers will be placed inside the United States under Northcom to “help state and local officials respond to a nuclear terrorist attack or other domestic catastrophe.”

“Domestic emergency deployment may be “just the first example of a series of expansions in presidential and military authority,” or even an increase in domestic surveillance, warned Anna Christensen of the ACLU’s National Security Project. And Cato Vice President Gene Healy warned of “a creeping militarization” of homeland security.”

The contention that the troops will merely help “recovery efforts” after a major catastrophe is contradicted by the fact that Northcom itself, in a September 8 Army Times article, said the first wave of the deployment, which was put in place on October 1st at Fort Stewart and at Peterson Air Force Base in Colorado Springs, would be aimed at tackling “civil unrest and crowd control”.

Congressman Broun has been a thorn in the side of Obama’s agenda since day one, voting against the “cap and trade” bill and slamming the entire concept of man-made global warming as a “hoax”.

He also spoke out against Obama’s plan to create a “national civilian security force,” warning that the program sounded like a 21st century Gestapo and that it was part of a move towards a Marxist dictatorship.

“That’s exactly what Hitler did in Nazi Germany and it’s exactly what the Soviet Union did,” Broun said. “When he’s proposing to have a national security force that’s answering to him, that is as strong as the U.S. military, he’s showing me signs of being Marxist.”

Broun also cited the threat to the second amendment posed by the Obama administration and anti-gun Attorney General Eric Holder.

“We can’t be lulled into complacency,” Broun said. “You have to remember that Adolf Hitler was elected in a democratic Germany. I’m not comparing him to Adolf Hitler. What I’m saying is there is the potential of going down that road.”

MSNBC’s Keith Olbermann voted Broun his “worst person in the world” on two separate occasions and attacked the Congressman as a racist and a bigot for expressing worries about the porous border with Mexico in relation to the swine flu outbreak. Olbermann claimed that Broun had “exploited a dead baby” to make his “sick, xenophobic and utterly irrelevant case about immigration.”

In November 2008, Olbermann erroneously claimed that Obama had called for a “civilian reserve corps” and “federally funded construction workers” when he had actually announced a plan for a “national security force,” as this video shows. Olbermann attacked Broun for expressing concerns about the program.


Now ask yourself these questions:

1. What is the name of the political doctrine President Obama and his administration has adopted from Communism?

2. What is the name of the political doctrine President Obama and his administration has adopted from Marxism?

3. What is the name of the political doctrine President Obama and his administration has adopted from fascist dictatorships?

Patrick Leahy can’t cite where congress gets the constitutional authority to mandate healthcare insurance.

Yesterday I wrote a post about Steny Hoyer’s asinine claim that the “general welfare” clause gives congress the right to force people to buy healthcare insurance, but today when Patrick Leahy ws asked where in the constitution power was granted to congress to mandate healthcare insurance he couldn’t do it.

When asked specifically to point out where the authority was granted to congress in the constitution, Leahy answered with a question of his own:

We have plenty of authority. Are you saying there is no authority?

They just have the authority? When asked again this was his answer:

Why would you say there is no authority? I mean, there’s no question there’s authority. Nobody questions that

Still he refused to cite where the constitution granted congress the power to force the American people to buy healthcare coverage. He states, “there is no question there’s authority,” but he cannot prove that statement. Instead he says that nobody questions the fact that congress has this authority. And perhaps he is right, not about whether congress has the authority, but rather the fact that nobody, or at least enough people, do not question whether congress has the authority. Congress does not have the authority to mandate healthcare insurance and it is well beyond time for people to begin questioning the constitutionality of mandate such as the one being proposed. As well as most of the laws passed in the federal government.

When asked once again Patrick Leahy claimed that the same provision in the constitution that allows the federal government to regulate speed limits is the provision that allows healthcare mandates; evidentially he is unaware that states regulate the speed limits in their own states. The federal mandate of speed limits was repealed in 1995.

Asked one last time Senator Leahy walked away, never answering the question.

According to Leahy’s theory we aren’t supposed to question if congress has the authority to mandate healthcare insurance or where they get that authority, we are just supposed to acknowledge that they have it– sounds dictatorial to me when instead of questioning authority you are relegated to accept it.

The problem is that while Leahy just assumes that the American people will not question the authority of congress on this issue he has the bases covered if they do eventually question congress’ authority. Patrick Leahy is the chairman of the Senate Judiciary Committee, the committee that vets Supreme Court nominees. Certainly President Obama will nominate judges to the Supreme Court who hold the belief that congress is empowered to mandate healthcare insurance and a committee headed by Patrick Leahy will approve them.

Congress may not have the authority to mandate healthcare insurance but eventually the Supreme Court will have enough justices sitting on the bench that are sympathetic to the position that congress has this authority. Once that happens it doesn’t matter if healthcare mandates are constitutional because the Supreme Court will never rule against the mandates. The Supreme Court will adjudicate healthcare mandates into the constitution.

He knows that he doesn’t have to cite the constitutional authority of healthcare mandates because if he and President Obama have their way and seat the proper justices on the Supreme Court they will do it for him.
